Based on the information you’ve provided, here’s how you can navigate the HRA (House Rent Allowance) claim for both you and your wife:
### 1. **HRA Claim for You (Defence Services Officer):**
- **Situation:** You are an Officer in the Defence Services posted in Delhi and staying in rented accommodation in Noida.
- **Eligibility for HRA Claim:** - As an employee posted away from your official station (Delhi) and staying in rented accommodation in Noida, you are eligible to claim HRA for the rent paid in Noida, subject to the conditions laid out under Section 10(13A) of the Income Tax Act.
- **Conditions:** - You must be paying rent for the accommodation in Noida. - Maintain rent receipts and a rental agreement as proof of rent payment. - Ensure that the rent paid is within the limits specified by the HRA calculation formula, which is: - Actual HRA received by you, - Rent paid minus 10% of your salary, or - 50% of your salary (for cities like Noida, which is treated as a metro area).
### 2. **HRA Claim for Your Wife (Haryana Govt Employee):**
- **Situation:** Your wife is a Haryana Government employee posted in Rohtak and is receiving HRA as part of her salary.
- **Eligibility for HRA Claim:** - Your wife is entitled to claim HRA for the rent paid if she is staying in rented accommodation while being employed. Since her place of posting is Rohtak, and if she is paying rent in Rohtak, she can claim HRA for the rent paid there.
- **Conditions:** - The rent must be paid by your wife. - She must maintain proper documentation (rent receipts and rental agreement). - The HRA claim will be subject to her actual rent payments and HRA received from her employer.
### **Important Points to Note:**
1. **Both Claims are Independent:** - Your claim for HRA and your wife’s claim for HRA are independent of each other. Each of you can claim HRA separately based on your respective rental arrangements and employment conditions.
2. **No Restriction on Claiming HRA Based on Spousal Employment:** - There are no specific restrictions against both spouses claiming HRA if they are both in different postings and paying rent in their respective locations.
3. **Documentation:** - Ensure to have all relevant documents ready, including rent receipts, rental agreements, and proof of HRA payments for both you and your wife.
### **Summary:**
- **You**: Eligible to claim HRA for rent paid in Noida, provided you meet the conditions of Section 10(13A) of the Income Tax Act. - **Your Wife**: Eligible to claim HRA for rent paid in Rohtak, provided she meets the conditions for HRA claim in her own employment context.
