i want file my income tax return for a.y. 15-16. i have job in foreign and my salary is credited to indian bank in indian currancy. and i am engage in this job since last one year. before that i work in india. n previous year i leave in india only for 60 days. so now how can fillied my income tax return and on which basis i.e. residance indian or non- resident indian

18 May 2015 Assuming that you mean FY 14-15 as 'previous year' relevant to AY 15-16, as per section 6, you do not satisfy the first condition which requires you to stay in India for a period not less than 182 days in aggregate in previous year i.e. FY 2014-15.Now the second condition is that you must have stayed in India for not less than 365 days in aggregate for four years immediately preceding the previous year and not less than 182 days (explanation (a) instead of sixty days 182 days for a person who leaves India for employment outside India). Even this condition is not satisfied in your case as per your contention that you lived in India only for 60 days in previous year.
It means that your status will be non resident for AY 2015-16 and all your income will be foreign earned and as such not required to pay Indian income tax on such income even if it is credited to your Indian bank.

INCOME EARNED ABROAD NOT TAXABLE
HOWEVER INCOME EARNED IN INDIA LIKE INTT WILL BE TAXABLE
