Excess service tax collected

According to provision of service tax, excess service tax collected has to be deposited to Govt. However if such collection is returned , then whether no such provision applies?

11 September 2011 If refunded then not applicable but it has to be refunded within the quarter in which collected.

First of all if you have collected ST which is not to be collected then you have collected it illegally and you have to deposit it to the credit of the Central Government.
