Deduction of TDS

13 July 2010 I am constructing a building and do not want to show the contractor. I want to show the labours as my firms employee. In this way I have not to deduct the TDS upto Salary of Rs.160000/-. At the month end I want to transfer the salary of building under construction. Is it correct way or not. Kindly give me suggestion.

13 July 2010 According to me do not show labour as employee because if you will show them as an employee then the Labour Laws may apply which may create problems. Moreover construction will be considered as business for you and you can pay wages to the employee. Wages are part of salary u/s 17(1). Hence TDS will be applicable u/s 192. So the exemption limit of Rs. 1,60,000 shall be available.
