Cenvat of excise duty on capital goods imported

05 December 2013 Let me make my query simple and straight.. for e.g. I purchase a capital good for Rs. 100 , paid Rs. 10 for custom duty, Rs. 8 for c.v.d., Rs. 5 for additional duty, Rs.3 for edu cess and Rs.2 for SHEC, so gross amount is Rs. 128, now tell me which duty can be used as cenvat credit and credit allowed in the same year or 50-50 concept. one more thing I have heard that cvd benefit is allowed as 50-50 and add. duty full benefit in same year. kindly put light to my confusion.

07 December 2013 You can take the cenvat credit of CVD and SAD on imported capital goods. You can take the cenvat credit of 50% current year and 50% next financial year.
