Company is falling under payment of bonus act, declared and paid bonus for all on roll employees.
Whether company is liable to pay bonus for those employees who has been resigned before disbursement of bonus and their wages is more than 10,000/- (Company is paying bonus to even those employees which is on roll and their salary is more than Rs. 10,000/-.)?

1. Bonus is calculated on 31st March (for attendance during April to March). The actual disbursement may happen lateron. So, whosoever was on roll during any April to March, bonus will be calculated for him on 31st March.
2. It is not mandatory to make provision for bonus for those employees, whose basic salary is more than 10000/-. Even if the company is paying bonus to all employees (even getting higher than 10000/-), its not mandatory to pay bonus to all, who is getting basic salary more than 10000/-
Sir as company practice that we are paying bonus to all on rolls employees and some employees who has been resigned and claiming the bonus. Whether company is liable to pay bonus to them or not?

As I said in my earlier reply, if they are within that frame i.e was employed during some part of April to March and was drawing a basic salary upto 10000/- per month, then the company is liable to pay them their bonus.
