Facts : A client is required ot get his accouts audited under this section, he instructed his accountant to get accounts audited with the CA to whom he knows. Accountat got the audited report and handed over to the client which in tern filed with the Department. Now the CA whose stamp and signature exist on the report is admitting that the report is not signed by him but by some other person in his name wothout his knowledge. SO THE QUESTION IS THAT HERE WHO IS IN DEFAULT, AND WHAT ARE THE REMEDIES.

the client is default the auditor told he is not audited,accoutant is also responsible for this audit find out who sign the audit reports. generally when auditor is appointed he gives his consent for doing audit

I think u can take legal action against tht CA...how can he deny the fact of signing the Tax audit when his sign n seal is affixed...Otherwise please contact ICAI (quote his membership no while mentioning the issue) also enquire tht accountant as to who signed the report before taking futher action.
