Can any service provider, without having registered his firm/ company/ institution under Service Tax i.e. without having STP code, collect service tax @ 10.30%?

If he is doing so it is illegal plus if he is over minimum limit he should get registerd or he might face severe consequences

The probalem could be that the client/ cusotmer may not get credit and you would have to send the registration certificate later for him to claim the same. |

If the service tax is collected by any person, whether registered or unregistered, It is mandatory to deposit such service tax to the credit of central govt.

Yes section 73a specifically p[rovides that such payments are tobe depoited with the revenue.
An alternative if not liable is to pay the same back to the cusomter and proof of the same retained.
