Vat / service tax

Dear sir we are in manufacturing process, recently we have hire the xerox machine on rent basis. for this service, while giving bill he is charging vat is correct or not. my view he has to charge service tax is right? if yes please provide me any notification or circular to justify. thanks in advance kumar
