I need a format for entering into contract with employee, where no statutory deductions are not applicable (PF & ESIC).
Secondly can a company enter into such type of agreement, if so under what rule/act/section ?

As per the Pf act u should pay PF to the employees. For the applicability there are many issues like minimum employees and many more.
U cannot enter into an agreement where there is a statutory rule for the PF. If u enter also it is not a valid agreement.
Statute prevails over the Agreement.

I suggest to all big compnies whom want to give some service,they ought to setup penshion contribution scheem and health allowance etc.
