Company A is PE in India. Now Company A is hiring an Agency B, which is from out side of India and don't have any establishment in Inida. Now, Company A has to pay service tax on belhalf of this Agency B.
In this case, My query is that Can Company A get CENVAT refund from the GoI for the service tax paid on belhaf of a foreign company?
Please guide.

as per new negative list base service tax any amount comes under reverse charge we have to pay tax in cash without utilising cenvat credit and take a set off for the same.
