Dear Aurn,
U have again mixed two deductions -
80 C -Tution fee- can only be claimed for children (maximum of 2) - not available for self
80 E - Interest on loan for higjer studies is allowed even if loan is taken for self.

U/s. 80C - Tution Fees for u'r self can bot be claim.

Arun, no ur father cannot claim it, as its paid by u and not by ur father..... The simplest logic.

Section 80E provides for a deduction in respect of interest paid on loan taken for higher education.
Its nothing related to tuition fees.

i have a query regarding 80E deduction....
i saw in one book that ...
The loan was taken by the taxpayer for the purpose of pursuing his own higher education (or from the A.Y. 08-09, for the purpose of higher education of his relatives i.e. spouse/ any child).
please clarify...

Distance education there is nothing called tution fee(i think) so there is no way you can take 80C deduction. If the Fee reciept mentions about tution fee then, next question is, "IS IT PAID BY CASH" if it is paid by cash or DD taken using cash(not bank account or cheque) then you can always take a stand that its your father's cash. IF it is paid by you through cheque or bank transfer then sorry there is no way you can take 80C benefit by my view. and 80E is for the interest paid on Loan taken for higher studies from recognised financial institutes. so you cannot say that you have taken loan from your father and interest is paid to him... so 80E totally ruled out

80 E is available for higher studies of the assessee or his relative -
relative”, in relation to an individual, means the spouse and children of that individual or the student for whom the individual is the legal guardian.
