Very very urgent- tax demand

16 February 2012 assessment year 2007-08

my client has left india on 29/09.2006 for employment outside India i.e. Zambia . He has received salary income in USD currency from outside india (Zambia) on which said country has deduct TDS in terms of USD( $). in India in income tax return (ITR) salary received from Zambia has shown as salary income in ITR and claimed setoff for TDS deducted in Zambia. But said TDS amt. is not shown in form 26AS of assessee as this TDS amt was deducted by Otside country. Now Deptt. has raised demand of Rs. 7 lac


Plz suggest how I can solve this matter. as this is related to assessment year 2007-08. No TDS amt. is shown in form 26 AS coz TDS deducted outside India but income claimed in india in ITR

17 February 2012 You can submit the TDS Certificate received from Jambia with reference of DTAA with Jambia

19 February 2012 Yes, the matter can be solved by producing the Salary Certificate and TDS Certificate from the foreign employer or at least that document on the basis of which you have claimed the tax credit and shown the income.


19 February 2012 Yes I have slary and TDS certificate whether these will be sufficient documents in this case. Plz inform me detail procedure to follow up with Deptt,.
