Tds on salary

This query is : Resolved

30 April 2012 What should do if employee forgot to give his PAN no to his employer and employer deducted TDS @ 20%. While he is in only 10% slab rate. How can he claim refund?

30 April 2012 He can claim the refund from the department by filing his ITR.

30 April 2012 No madam I come to know that he should request employer to revised TDS return by givinng them PAN no.

30 April 2012 Yes!! the employee should furnish his PAN no to employer & ask for a TDS certificate which has his valid PAN no. Once he has the certificate, file the return & ITO will provide him refund & it's the duty of the employer to revise his return accordingly.

30 April 2012 Once TDS is paid and deposited into treasury of Government then the only way to get back the refund is to file IT return.

Thanks

07 May 2012 es it is obligatory to revise the return as who has deducted tax has to say that excess has been deducted as no PAN was given now it is given so the excess can be claimed provided the TDS return is revised by the employer
