TDS ON DISPUTED DUES

15 September 2010 WE HAVE BEEN MAKING PROVISIONS FOR CERTAIN CHARGES PAYABLE TO JNPT PORT WHICH ARE LIABLE TO TDS , HOWEVER SUCH AMOUNTS ARE NOT BEING PAID TO JNPT DUE TO A DISPUTE REGARDING QUANTUM OF CHARGES PAYABLE AND THE MATTER IS OPEN IN COURT, PROVISION IS MADE FOR AN AMOUNT WHICH MANAGEMENT BELIEVES IS PAYABLE BASED ON CURRENT LAW.
IS TDS DEDUCTIBLE WHEN MAKING SUCH A PROVISION CONSIDERING THE FACT THAT THE AMOUNT IS IN DISPUTE AND JNPT IS REFUSING TO ACCEPT PART PAYMENT.

15 September 2010 Unless you abide by the TDS laws, you cannot claim that expenditure or provision against your taxable income.

16 September 2010 OK, however my query is whether TDS is deductible on such a disputed provision
