Thank Sir. payee is Insurance broker & India has DTAA with Belgium. As per DTAA if any fee paid for any technical service then deduct 10% tax. But we are paying Conferance fee. It may be possible we will pay 3 to 4 time this type of fee in next FY. Please advise. Payee is not agree to deduct TDS, then in this situation what should i do?

Conference is organised outside India, this is neither arised and accrued India hence not taxable India and since not taxable in India no TDS applicable in India.

If we pay commission to Foreign company & we have DTAA,& as per DTAA only written that 10% rate for TDS to be deducted for technical services. Should we also deduct tds @10% on commission.
If yes, then how other party can take credit of tds in his country?
