Tds not to be deducted at source,self pay

01 December 2012 DEAR SIR,I RECEIVE A RENT OF 3LAKHS YEARLY FROM BSNL,WHERE THEY DEDUCT TDS.WHEN I GO FOR REFUND I WAS SAID AT INCOME TAX ,THE DEDUCTED MONEY WAS NOT PAID AT INCOME TAX DEPT.MY QUESTION IS IS THERE ANY WAY OF RECEVING THE TOTAL RENT WITHOUT DEDUCTION AND I SHALL PAY THE ACTUAL TAX AMOUNT AT THE INCOME TAX COUNTERS?HOPING TO FIND A SOLUTION FROM U.THANKS AND REGARDS.RAJ

01 December 2012 Send a letter to bsnl office (Deductor) regarding the deducted amount... requesting to him either deposite this amount to income tax dept and file the return.. or directly pay to you. If they will deposite and file the return then this amount will be shown in to your 26As. According to 26AS you can claim this amount.

01 December 2012 If you want to receive rent without deduction of TDS then you will have to obtain a certificate u/s 197 from your Assessing Officer for non deduction of tax.

Such certificate can then be submitted with BSNL and they will not deduct TDS.

12 December 2012 thanks a lot sir.there is a doubt sir,is u/s 197 is also eligible for collecting rent,because that form is difficult for me understand.thanks for the above help and forthcoming help.thanks raj

25 December 2012 Section 197 is applicable for ALL incomes on which TDS is required to be deducted.
