TDS not ot be deducted for Transporter Payments

This query is : Resolved

27 October 2009 Effective 1st October the Income Tax notification says payments made to Transporters will not be subject to TDS provided the Transporter provides a copy of his PAN Card.

In case of a Propreitorship concern if the Transporter provides a PAN Card in his "personal" name, can we avoid deducting TDS against his bill raised in his Properitorship firm.

Kindly advise.

27 October 2009 In my opinion you are right. If a propreitor quate his own PAN card no then we will not deduct TDS.

27 October 2009 Yes, Aroop
If Transporter Provides PAN No to Concern Person Who is Liable to Deduct TDS on Payment of Transportation,Its Free from Deduction but its only for Transportation Charges.
W.E.F :- 1/10/2009

27 October 2009 Many thanks to both of you Gentlemen.

28 October 2009 Agree with experts and any proprietorship business can only have PAN of the owner as in the eye of law the status of any Proprietorship business is “Individual”
