26 April 2012 DEAR MEMBERS,

PLEASE SUGGEST THE FOLLOWING QUERY:-

a firm xyz, received bills falls u/s 194C on for example 1-4-12, 5-1-12, 7-1-12, 31-1-12.

accountant deduct the TDS @ 2% on 31-1-12 and deposit before 7-2-12.

is there any late deduction applicable on first 3 bills or not.
thanks.

26 April 2012 Please give the dates correctly. You have written TDS deducted on 31-3-12 and deposit before 7-2-12. Also you have given the date of first bill as 1-4-12.

Please give correct dates.

27 April 2012 question date is modified.

27 April 2012 I think the date of 1st bill will be 1-1-12 instead of 1-4-12.

If deposited on or before 7th Feb 2012 no interest need to be paid.

04 May 2012 If you have accounted on 31.1.2012 and deducted the tax and paid on 7.2.2012 then no interest is payable but if accounting entry has been passed before this date then you are liable for interest and penalty

04 May 2012 Sir i have deducted TDS on 31.1.12 on all bills for the month of January 2012, it may be of dt. 1,3,7,23,31 etc.

but deduction entry is passed on 31.1.12

04 May 2012 Ok. No problems with that if you deposit on or before 7th Feb no need to pay any interest. Late deduction will not be applicable.
