TDS deducted from salary income of NRI

This query is : Resolved

03 July 2009 I want suggestion on following
MRS.X left India 3 years ago for employment purpose.

MRS.X who is NRI worked in India for 3 months during Jan 09 to Mar 09 and get salary income of Rs. 64500. She is working in IT Co. IT co. deducted Rs. 64500 as TDS.

Plz tell me in above situation how she can get refund for the same as her income in India is below taxable limit and country in which she is working i.e. U.S. have DTAA.

04 July 2009 Hie Sidharth,

she needs to file her ITR in INDIA by declaring her income in acc with sec.5 of the income tax act. in the NRI cell of Income tax deptt.
When the return gets processed she will be able to take refund of that amount.

another alternative is to take credit of amount wht she has paid in INDIA as TDS in USA have DTAA with INDIA. when she will be going to file her ITR over there.....

04 July 2009 The process explained by Sanjeev is right, i agree with him.
