18 February 2013 if hoarding rent for advertising paid to co-op housing soc then under what section tds will be applicable? wat will be the rate.
plz reply.

18 February 2013 Dear Siddhi,

I think there was a clarification issued by the department for deduction on TDS u/s 194I.

so you may deduct tds u/s 194I

18 February 2013 The contract for putting up a hoarding is in the nature of advertising contract and provisions of section 194C would be applicable. It may, however, be clarified that if a person has taken a particular space on rent and thereafter sublets the same fully or in part for putting up a hoarding, he would be liable to TDS under section 194-I and not under section 194C of the Act.

Clarification vide circular no. 715 dated 08.08.1995.

in advertisement, it is an contract
yes, you took a place but it is not the place of land or something. So 194 I must not be used. use 194C
