Tax liability on nri person

29 August 2019 Sir,
My client is working at a private company in America. he has gone america in September 2018. And Now he gets salary R.s. 50,000/month from his JOB in America. Before Go to America , when He was living in India he was working in a hotel in India by Salary R.s.10,000/month . After Going to america, He Send Money to his Brother' s Bank Account per month.And The Account is a joint savings bank account.
My Question is,
1) Can he file Income Tax Return in 2019-20?
2) Which ITR Form Is Applicable for him?
3)Is His Brother in Tax liability for received the money from America?
4) Which moth's Income (when he worked in India or when he is working after going in America) is Liable for income tax ?

29 August 2019 01. yes, he can file income tax return

29 August 2019 02. he can file ITR 2


29 August 2019 03. No. His brother is NOT liable for any tax for the amount received in the joint account.

29 August 2019 04. For computing tax liability, first you need to find out the residential status. Find out the number of days stay in India for the financial year 2018-19. (Mostly he will be out of India for more than 182 days.)

29 August 2019 If, His residential status is non resident for more than 182 days out of india ,then can i put his income in ITR , which has received from Job of America?
Or, Both income i will put which has received from both country India And America ?

30 August 2019 the income from America is EXEMPT since he is Non Resident.You can show the same under exempt income.
