SERVICE TAX ON LIASIONING

18 October 2007 Dear friends,

One of my Client has following wordings in his appointment letter,

"We are pleased to inform you that you have been appointed as a Retainer for assisting in liaison with the various Government Bodies and offices. You will be acting as a co-ordinator on behalf of M/s Magna International Inc. India Liaison Office."

would u pls. suggest me under which service it will be registered in Service Tax Act.

18 October 2007 Dear Sir

It can not be classified under Management/Business consultancy services U/s 65 (65)of the Finance Act 1994, for sure as the definition is not at all covering the liasion service with Govt Offices/Bodies.

Similarly Business Auxiliary Services can also not cover the aforesaid service.

However the same may be covered by Section 65 (104 c) of the FA 1994, i.e. Business Support Services circumvendingly-

"... infrastructure support services and other transaction processing"

But since you have very sound chance of claiming not to have been covered by service tax, write officially to your jurisdictional STAO the same and get legally insulated and avoid taxation.
