Dear Sir, I have made payment in march to a job worker for preparation of machine components. The payment was made for whole amount including service tax but i doubt that the job worker will not pay the service tax collected by him in such case can i take the credit of the service tax which i have paid if the job worker does not pay the service tax and will there be any default on my side in this matter. Further if i have claimed the credit and the job worker does not pay the service tax will i have to reverse the credit which i had taken

Please check whether in the invoice the Job worker has mentioned his Service Tax regn No. If its not there then you can ask him whether he is registered. If he is not then you can not claim the credit. If he is registered then you can claim the credit as payment of Service Tax is liability of the Job vendor and not yours. But make sure he is registered.
