builder build residential complex with 10 units. He also construct 10 shops in same building. So whether service tax is chargeable on sale of residential units n those shops?
There are two types of services which are invovled in the above transaction,
a) Construction of Complex (Which will cover the residential part)
b) Commercial and Industrial Construction (This service will cover the commercial shops)
Based on the above you may claim exemption from service tax on residential complex as the residential units are below 12 numbers. For service in relation to commercial construction you will have to pay service tax under Commercial & Industrial Construction....
