My brother paying rent more than 1 LAC per year whereas his Land lard doesn’t have the PAN card but she is agreed to sign the “No Pan Card declaration form”. However in his office it was not accepted and informed him back that PAN is compulsory.
Here below they have given the government document, what I would like to know is – Since our company is accepting the “declaration form” there should be some amendments added to that. Can you check and confirm if it so any. It would be really appreciate if you get the official document for that.

Shyam, I am unable to see the document you have uploaded. The CBDT vide a Notification dated 29.04.2016 has introduced Rule 26C dealing with "Furnishing of evidence of claims by employee for deduction of tax under Section 192". This Rule requires certain evidence to be furnished by the persons receiving Salary, to their Employers. The evidence is to be furnished in Form No. 12BB. In case of HRA, the deductee is required to furnish the Name, Address and PAN of the landlord where aggregate rent paid during the previous year exceeds Rs. 1 Lakh. As far as i know there has not been an amendment yet. My fellow experts may correct me if i am wrong.

You are right Mr. Anand. Where payment of rent exceed Rs. 1 lac per annum, the employee is required to show PAN of landlord to the employer. Hence, PAN is mandatory. Owner should apply for PAN in prescribed form. 49A which he will receive within 10-15 days.
