Regarding TDS

I received one service bill. whether Tds has to be deducted including service tax or excluding service tax? Please give the reference of section/any case law.

There is no specific support for this but for the safer side it becomes coustom to deduct TDS on gross amount.Moreover words used in chapter of tDS are amount credited in the account of payee,and payee is credited with gross amount including TDS .Therefore TDS should be deducted on gross amount.
