The Tax deducated at source while making reimbursement of medical expenses incurred at a hospital recognised by the commissioner of IT is mentioned in Form 16 issued by the Company.(Form 24Q filed accordingly)

Can the assessee employee claim refund of Tax in his return of income?

Querry No. 2.

An assessee employed in a limited Company inforporated under Companies Act, 1956 is in service for last several years. During the accounting year ended on 31.03.2010, the employee is requesting for issue of Form 16 indicating in the column details of salary " From march 2009 to February 2010 " as he is filing his return of income in each year from March to February

Can the company issue Form 16 for the period from March 2009 to February 2010 to the employee (Senior Citizen) who continues to be in service in March 2010?



25 April 2010 Q 1 - Yes whatever your tax has been deducted would be refunded if your income is not taxable or less taxable.

Q 2 - The Income Tax recognises financial year "From 01-Apr-20xx to 31-Mar-20xx". So, a company can not issue form 16 as it would mean that it (Co.)has diverted from prescribed path.
