Yes,service tax shall be levied @ 12.36%. Please refer circular no.139/8/2011-TRU it says that in room dining cannot be charged under restaurant services or short term accomodation service. Therefore in case of in room dining neither the abatement of 60% can be availed n neither the exemption . Therefore service tax shall be paid on same @12.36%.
