place of filing return

This query is : Resolved

06 February 2010 according to my PAN,ITO jurisdiction is city A. I am doing business in city B.
I am filing my returns in city A. Is it legal.

06 February 2010 PAN No. is universal for the person and return filing is not related to PAN NO.
Also, it is not illlegal if you file your return whether in your residing area or your business area, howeever my personal preference is to file in the area of your business.

07 February 2010 Yes agreed, its not depend on your pan its depend on your business area, from that you have to file the returns..

07 February 2010 Agreed

07 February 2010 I don't agree with experts. I am also in same position. I am filing return in city A where I was living. Now for job I changed city but still I am filing return in City A from 7 years in which from 3 year I am in other city. So as per my view there is no problem you can do it as I am doing.

07 February 2010 Yes Mr. Prashant. I also said that there is no problem if you file return in City A where u r residing.
But my preference or suggestion is that its better to have it in your business area since ur income includes PGBP and in case there is some communications or anything relating to bussiness with IT dept..then communications at ur buss address seems to be ok.

Also, everybody have its different preference and situations ..but this is sure that there is no prob in filling return anywhere whether in City A or City B.

07 February 2010 Not agreed with experts. return should always be filed in the city to which the address given in PAN relates. If you want to file the ITR in the city of business, then you must first change the address in PAN, and then file ITR. These things creates problems at the time of return and assessments. Not at the time of return filing.
