08 January 2013 I was allotted PF account number from company and I avail PF deduction. But now from accounts department I came to know that the account number to which they were depositing amount has somebody else name and that person had worked for about 2 months. They are giving reason that error is from EPF Office and now they are saying I need to go to PF consultant to resolve it and accounts department will give all the necessary documents. First, I want to know the procedure and documents to change the name of the PF account and replace that person name with mine. and second, it this not the duty of Accounts department. 10 August 2024 Handling a situation where your PF contributions have been mistakenly deposited into an incorrect account due to a name conflict can be complex, but here's a step-by-step guide to resolving it:

### **1. Understanding the Issue**

The problem arises when your PF contributions are credited to an account that does not belong to you. This could be due to clerical errors, system issues, or mismatches in account details.

### **2. Procedure to Resolve the Issue**

**Step 1: Collect Documentation**

Gather all relevant documents that demonstrate the error and your rightful entitlement. These include:

1. **PF Passbook/Statement**: Proof of contributions and account details.
2. **Salary Slips**: Showing PF deductions.
3. **Company Communication**: Any communication from your employer acknowledging the issue.
4. **ID Proof**: Such as Aadhar card, PAN card, or passport for identity verification.
5. **Form 19 and 10C**: If you are withdrawing or transferring the account.

**Step 2: Notify Your Employer**

1. **Request Correction**: Formally request your employer’s HR or Accounts department to correct the issue and provide you with necessary documents.
2. **Written Complaint**: If the issue persists, file a formal written complaint with your employer, highlighting the problem and requesting assistance in resolving it.

**Step 3: Visit the EPFO Office**

1. **Visit EPFO Office**: Go to the nearest EPFO office with all collected documents.
2. **File a Grievance**: Submit a grievance application, detailing the issue and providing supporting documents.
3. **Submit Form 13**: If transferring the balance to the correct account, you may need to fill out Form 13 (PF Transfer Form) to initiate the transfer process.

**Step 4: EPFO Complaint Procedure**

1. **Online Grievance Portal**: You can also raise a complaint on the EPFO grievance portal [EPFIGMS](https://epfigms.gov.in/).
2. **Track the Complaint**: Monitor the status of your complaint and follow up as needed.

**Step 5: Follow Up**

1. **Regular Follow-Up**: Regularly follow up with the EPFO office and your employer to ensure that the issue is being addressed.
2. **Document Everything**: Keep a record of all communications and submissions.

### **3. Employer’s Responsibility**

**Employer’s Role**

1. **Initial Responsibility**: Your employer should ideally correct the error with the EPFO and ensure that contributions are properly credited to your PF account.
2. **Providing Documentation**: They should provide necessary documents, such as PF contribution details and correction forms, to facilitate the resolution.

**If Employer is Non-Cooperative**

1. **Self-Resolution**: If the employer is not cooperating, you may have to resolve the issue yourself, using the EPFO grievance process and necessary forms.
2. **Legal Recourse**: As a last resort, you could consider legal advice if the employer's negligence has caused significant problems.

### **Summary**

- **Documents Needed**: PF passbook, salary slips, company communication, ID proof.
- **Process**: Notify employer, visit EPFO office, submit grievance, track complaint.
- **Employer’s Role**: Ideally should handle initial correction; if not, resolve through EPFO.

By following these steps and maintaining communication with both your employer and the EPFO office, you should be able to resolve the issue of PF account name conflict and ensure your contributions are correctly accounted for.
