03 May 2013 Sir,

I am a resident of India and have been paying taxes and filing my return for last 6 years.

Next week I am going abroad to USA on job in an American company. This is a contract employment for 8 months (>182 Days).

1. Will I need to pay any tax on salary I will get there?

2. What will be my tax residency status for FY(2013-2014), when I am back in January 2014. Resident, Resident but not Ordinary Resident?

Please help

04 May 2013 sir,

For the FY 2013-14, you will treated as non resident as your stay in India is less than 182 days. Your income will not be taxable in India.

04 May 2013 Sir, Thanks for your reply.

Does that mean, for any Fiscal Year if I am out of India for >182 Days I need NOT to pay taxes on foreign income?

Nothing to do with those statements of preceding 4 year, or 9 of 10 years? etc...?

14 June 2013 Your date of departure is material if for part of the year you are in India and part in USA then on Indian income full tax and on USA income rebate. only stay above 182 days will give you the status of Non residential Indian and not Non Resident. Only for those days or months your income shall not be taxable but if you have income in India by way of FD interest then you have to pay tax on that in India.
