Service tax deptt. has imposed penalty for late deposit of service tax, whereas the tax and interest thereon was deposited before issue of SCN, I have quotated 4-5 case law for not imposing penalty in such cases

I have searched this circular but not found. I think there is some mistake in it as it is not appearing neither in 2006 or 2007 at CBEC site. if you can provide some detail about the text of circular it would be helpful in search
