pan application by legal heir

10 July 2008 my query is

one of my clent`s father(Mr. X) has died in june 2008.
mr. x did not had PAN but tds was deducted by some govt authority in 2007-2008 without quoting PAN.

now what is the procedure to get refund of tds??
wheather his son has to apply for pan in the name of late mr x?
or he can file return as representative without mr x`s pan?

plz guide me.

11 July 2008 PAN may be applied by the legal heir as a representative of the deceased assessee. Clause No 14 of Form 49A is meant for the particulars of the representative assessee while the PAN application will be in the name of father. The particulars of father are to be given in Clauses 1 to 13 of the said Form.
