19 September 2013 Hi,

I am into marketing, EMPLOYED in SINGAPORE. Mostly living in Singapore but I Travel to India, Singapore, Thailand, Malaysia, Indonesia...Kathmandu too.

My question is: my days in Nepal is counted in "183 days outside India" or not? So if I have like 30-40 days in Nepal with entry & exit stamps in my passport - valid enough?

Someone said living in SAARC countries does not count! Please advise.

thanks and regards,

19 September 2013 You are correct , the stay in Nepal is excluded .

19 September 2013 I am unable to find any specific guideline/exclusion clause in this regards.

IT Website: http://law.incometaxindia.gov.in/DIT/File_opener.aspx?fn=http://law.incometaxindia.gov.in/Directtaxlaws/act2005/meaning.htm

Further opinion needed on this IT definition or any reference to a specific exclusion clause please..

23 September 2013 If you are asking from Income tax angle, you have to be outside India (as defined by Income Tax Act, 1961. Refer to section 6. Staying in Nepal should amount to stay outside India.
