Hello Sir my frd suffers from notice pay recovery from her office.. My frd went to office oct month fully... Bt her family situation (i.e father's death) pulls her to home sickness.. Due to she can't continue work in office... But now office sent a letter for her to recovery amount Rs.12568 I think that calculation was totally wrong... How can i attach the file with u... I need a solution for it.. Pls sir help me us

From your query, I understand that the employer is demanding notice pay amount for not continuing service. For this you have to look into the terms and conditions mentioned in the appointment order and which is usually signed by the employee for acceptance. Normally there will be 3 months notice period for either side. That is if employee left service before serving notice period he has to pay notice period salary fro the service not provided by them or if employer terminates the service before notice period , he has to pay salary for the notice period.
Even if notice period clause in appointment, you may request the employer for the waiver of notice period payment.
