Notice from IT u/s 143(2)

This query is : Resolved

04 September 2009 Hi!
I have received a notice dated 27 Aug 09 under section 143(2)from the Asst Commissioner of Income Tax asking me to appear before him on 16th Sep 09.

The letter does not ask me to bring along any documents but simply says that it seeks some queries on the tax return filed by me for FY 2007-08.

Does this mean that my tax assessment for the year 2007-08 (Assessment year 2008-09) is not done yet by them? I have never received any notice from them earlier.

Also, if on further examination of my books, I find some income undeclared in my return, can I file a revised return before the IT officer further assesses my returns? I had filed my 2007 returns in time.

Thanks

Shashank

04 September 2009 YOUR CASE HAS BEEN SELECTED FOR SCRUTINY

If any person, having furnished a return under sub-section (1), or in pursuance of a notice issued under sub-section (1) of section 142, discovers any omission or any wrong statement therein, he may furnish a revised return at any time before the expiry of one year from the end of the relevant assessment year or before the completion of the assessment, whichever is earlier :

04 September 2009 Thank you very much for the prompt reply. I really appreciate your efforts.

Actually, I have been issued a notice under sec 143(2) and not under sec 142, I don't know whether it makes a difference.

Since my case has been picked up for scrutiny scheduled on 16th Sep, can I review my books/records after 16th Sep, see if there is any omission and file a revised return before the Assessing Officer makes his assessment? I have not been asked to carry along any particular documents. I presume the AO will ask me for certain documents/proofs/records by a certain date. Can I check whether there is some ommission/error in my return and file a revised return before this date?

Thanks in advance.
