A letter from Income Tax Department (Compliance Management Cell) has arrived to a dear friend for failing to file the return of AY 2010-11 and henceforth. And have been asked to respond in a proforma attached.
My dear friend is in US on his job and have no access to the filed ITR's at the moment. We have all the past Form 16 from his service but ITR's are missing at the moment.
I want to know how do we deal (parents) with this? We have run out of 10 days reply time.
Can parents write on his behalf to IT department to get sometime asking for his return till they find the papers.

Your dear friend is in US and I hope that in US he must be having a mobile to talk with his dear friend in India and his parents. . First contact him and ascertain..... . If he has not filed the return, his parents can reply to the notice by furnishing the TDS certificates and submit valid/ reasonable grounds fro non -submission. .

Thanks for responding mr Bafna. My friend had filed all the returns . As mentioned, we haven't been able to find the missing itr of the last few years. But we have the form 16 issued by his office for all the years in question.

May I assume that you have confirmed this from his account at e-filing website ? . The letter from the AO shows that manually the return have not been filed. . You can show Form 16 to the AO and request him to re-check his records by reporting the situation. He will not recheck but advise what to do and how to proceed? .
