Mr ram lal., service tax has to be paid to the person who is providing you service., the return is filed by the service provider., you can take the credit of service tax., if the service provider mentions that the amount is inclusive of service tax and mentions the service tax registration no. on the invoice...

My question is that we r service receiver. service provider providing service from April, 2013 @ Rs. 350000 per month. and he get registered under service tax 18/07/2013. Service provider ask us to pay service tax from April 2013.
whether we may pay the service tax from April 2013 on revised Bill or invoice. and if we pay service tax from April 2013, then we r able to take credit for the same.

mr ram lal ., i understood the situation., ask your service provider to issue a supplementary invoice for the service tax which he is collecting from april first., and the date on the invoice shall be the present date., so by paying the amount you can take the credit of the service tax which you will be paying know.

mr ram lal i think you did not understood me..., the service tax which you will be paying know can be taken as credit in this period and you can pay the balance service tax only ., for example if you are also a service provider and paying service taxes and you are taking the credit of service tax., you can take the credit of service tax which you are paying know to your service provider ...
