02 August 2024 In the context of service tax liability for individuals or entities providing services such as gardening, peon services, or housekeeping, here's a detailed breakdown:

### **1. Understanding Service Tax Liability**

**a. **Service Tax on Service Providers:**
- **Applicability:** Service tax is levied on services provided by service providers if their gross receipts exceed the prescribed threshold limit. As per the Service Tax Rules, service tax is applicable to various categories of services provided.

**b. **Categories of Services:**
- **Gardening, Peon, and Housekeeping Services:** These services fall under the broader category of "manpower supply" or "employment services."

### **2. Exemptions and Threshold Limits**

**a. **Threshold Limit for Exemption:**
- **Exemption for Small Service Providers:** There was an exemption threshold limit under the Service Tax regime where service providers with gross receipts up to Rs. 10 lakhs were exempt from paying service tax. However, this exemption limit has been abolished with the introduction of GST from July 1, 2017.

**b. **Specific Exemptions:**
- **Services Provided to Government:** Under the Service Tax regime, services provided to government or local authorities (such as Nagarpalika) were often exempt.
- **Specific Service Categories:** For example, certain services related to agriculture or educational institutions might have been exempt.

**c. **GST Impact:**
- **Introduction of GST:** With the introduction of Goods and Services Tax (GST) from July 1, 2017, service tax was subsumed into GST. GST applies to all taxable services, including manpower supply services like gardening, peon, and housekeeping.

### **3. GST Applicability**

**a. **GST Registration Threshold:**
- **Threshold for GST Registration:** For GST, businesses with aggregate turnover exceeding Rs. 20 lakhs (Rs. 10 lakhs for special category states) are required to obtain GST registration.
- **Liability to Charge GST:** Once registered, the provider of services such as gardening, peon, or housekeeping is required to charge GST on the services provided.

**b. **GST Rates:**
- **Rate of GST:** The rate of GST on manpower supply services varies. Generally, it is 18% (9% CGST + 9% SGST) unless specifically exempted or subject to different rates under specific headings.

### **4. Practical Steps**

1. **Verify Registration Requirements:** If your gross receipts exceed the threshold limits, ensure you obtain GST registration.
2. **Charge GST:** Charge GST at the applicable rate on the services provided and comply with the filing requirements.
3. **Exemptions and Compliance:** Check if any specific exemptions apply to your services under GST and ensure compliance with the filing and payment requirements.

### **Summary**

- **Service Tax Liability:** Before July 1, 2017, service tax would have been applicable if gross receipts exceeded Rs. 10 lakhs, though there were exemptions for certain categories.
- **GST Regime:** Post-July 1, 2017, GST applies to all taxable services including gardening, peon, and housekeeping services.
- **Registration and Compliance:** Ensure GST registration if turnover exceeds Rs. 20 lakhs, and comply with GST rates and filing requirements.
