Landowner are entering into MOU with builder for construction of flat. Landowner will receive 33% of gross revenue as consideration. Income Tax implications for landowner?? By merely stating in MOU that possession is not given to builder only license to build is given and possession will be given at that time of actual transfer to prospective buyers. Whether this is sufficient for deferring capital gain tax? Will Mou between them be taxed as AOP under PGBP?
