ITR OF COMPANY WITHOUT DIGITAL SIGNATURE

06 August 2010 I had filed an ITR of a company on 15.07.2010 without affixing digital signature. I was not aware of the amendment made w.e.f. 09.07.2010 which says that ITR of a company can not be filed without digital signature. Now what should I do? Should I file return again?

06 August 2010 In my view please revise your ITR and this time sign digitally.

06 August 2010 Here I have a different opinion.

In fact, Revised return means that you can re-file your income tax return with some modification. If a person has already submitted his return of income and subsequently he discovers any omission or wrong statement therein, then only he may furnish a revised return for any previous year at any time before the expiry of 1 year from the end of the relevant assessment year or before the completion of the assessment.

However, in the given case the mistake is on the part of Income Tax Depttt, whose online filing utility has accepted a defective return (i.e. acceptence of digitally not signed return) despite the fact that at that point of time it was mandatory to file digitally signed returns only (i.e. post 9th July10). So the assesssee is advised to approach Bangalore CPC / Local AO for the remedy and keep proof of the communication in the matter.
