If any body upload return (by mistake) but dont send acknowledgement to banglore. now he receive msg from cpc to send the same. what has to be done if that acknowledgement is not right & that return also cannot revised because original return was belated return.

Not sure the legal position in your case. Your return without compliance to ITR V is invalid. It is as if you never filed a return. If the mistakes you notice are minimal then go ahead with ITR V and then take up rectification of the return if your not going to change the Gross total income in the return.

AS PER SECTION 139(5): ITR CAN BE REVISED ONLY WHEN SUCH ORIGINAL ITR HAS BEEN FILED UNDER SECTION 139(1) I.E. WITHIN DUE DATE.
IF ORIGINAL ITR HAS BEEN FILED UNDER SECTION 139(4) I.E. BELATED, THEN THE SAME CAN NOT BE REVISED UNDER SECTION 139(5).
HOWEVER, AS MENTIONED TEXT IN SECTION 139(5): ORIGINAL ITR FILED UNDER SECTION 139(4) I.E. BELATED CAN ALSO BE REVISED IF THERE IS BONAFIDE MISTAKE ON THE PART OF ASSESSEE.
THEREFORE YOU CAN REVISED YOUR INCOME TAX RETURN EVEN THOUGH IT HAS ORIGINALLY FILED BELATED.
AFTER FILING REVISED ITR (ORIGINAL BELATED) SENT TO CPC-BANGALURU WITH DETAILS OF THIS MATTER IN ONE LETTER.
