02 August 2024 ### Handling Intimation Under Section 139(9) for Trusts (ITR-7)

When you receive an intimation under Section 139(9), it indicates that there were some errors or discrepancies in the originally filed ITR-7, and you are given an opportunity to rectify these errors.

### **1. Rectification of Errors:**

- **Identify Errors:** Carefully review the intimation under Section 139(9) to understand the specific errors that need correction.
- **Rectification Return:** File the rectified return addressing the errors mentioned. You should include all necessary corrections.

### **2. Trustee Information:**

- **Trustee Details:** The details of the trustees included in the rectified return should ideally reflect the trustees as of the date the rectified return is filed. If there have been changes in trustees, you should update the trustee details to reflect the current trustees at the time of filing the rectified return.

- **Current Trustees:** It is essential to update the trustee details to reflect the current trustees who are in office as of the date of the rectified return. This ensures accuracy and compliance with the latest trustee information.

### **3. Filing the Rectified Return:**

- **Original Return Reference:** When filing the rectified return, ensure you reference the original return's details.
- **Attach Necessary Documents:** Include any necessary documents or explanations to support the rectification.
- **Submission Method:** File the rectified return electronically, as per the regulations.

### **4. Trustee Signatures:**

- **Signature of Trustees:** The rectified return should be signed by the trustees who are currently in office at the time of filing the rectified return. The trustees who signed the original return should be replaced with the current trustees if there has been a change.

### **5. Reference for Filled ITR-7:**

Unfortunately, I can't provide specific filled examples of ITR-7 forms directly. However, you can follow these general guidelines:

- **For Examples:** You can refer to the Income Tax Department's official website or consult with a tax professional for sample filled ITR-7 forms. Many professional tax websites and forums also provide filled sample forms for reference.
- **Consult a Professional:** If you're unsure about any specific fields or need assistance with the rectification process, it’s a good idea to consult with a chartered accountant or tax professional.

### **Summary:**

- **Update Trustee Information:** Reflect the current trustees in the rectified return.
- **Rectify Errors:** Address all errors pointed out in the intimation.
- **Signature:** Ensure the rectified return is signed by the current trustees.
- **Filing Method:** File electronically as per guidelines.

If you need further assistance or have more questions about specific fields in the ITR-7 form or the rectification process, feel free to ask!
