02 August 2024 As a government contractor involved in constructing facilities like a cafeteria and public toilets, you can generally claim Input Tax Credit (ITC) on GST paid for purchasing bricks, subject to certain conditions and restrictions. Here’s a detailed explanation:

### ITC on Bricks

1. **ITC Eligibility:**
- **Nature of Supply:** Since you are a contractor providing construction services, the bricks you purchase are considered inputs for providing the taxable construction service. Thus, the ITC on bricks is generally available.
- **Rate of GST:** You mentioned that the GST rate on bricks is 5%. This is a standard rate for certain types of bricks under GST.

2. **Conditions for Claiming ITC:**
- **Registered Contractor:** You must be a registered taxpayer under GST.
- **Use of Bricks:** The bricks must be used in the course or furtherance of your business. In this case, as the bricks are used for constructing a cafeteria and public toilets, they are used in the course of fulfilling your government contract.
- **Tax Invoice:** Ensure you have a valid tax invoice from your supplier showing the GST amount paid.
- **Proper Documentation:** Maintain proper documentation, including invoices, payment vouchers, and other relevant records, to support your ITC claim.

3. **Restrictions on ITC:**
- **Government Contracts:** If the output supply of your work contract is exempt (which is often the case with certain government contracts), the ITC on inputs like bricks may still be claimed because the exemption usually applies to the final output and not the input services or goods.
- **Construction of Public Facilities:** If the construction services provided are for government projects, the ITC should be available unless there are specific restrictions or exceptions in the contract or related regulations.

4. **Compliance:**
- **Reporting in GST Returns:** You will need to report the ITC claimed on bricks in your GST returns. This will usually be reflected in the GSTR-3B and GSTR-1 forms, as applicable.

### Summary

You should be able to claim ITC on GST paid for purchasing bricks if:

- You are a registered contractor under GST.
- The bricks are used in the construction of facilities as part of your government contract.
- You have a valid tax invoice showing the GST paid.
- You follow the prescribed compliance procedures for claiming ITC.

**Recommendation:** For the most accurate advice tailored to your specific contract and operational setup, and to ensure compliance with all GST regulations, consult with a GST consultant or tax professional.
