This query is : Resolved

15 June 2023 Dear Sir,

Company has planned for Staff Tour within India. For Tour We arrange all things like Transportation, Hotel Booking, Food etc. from One organizer and He will raise Invoice to us with tour Package services.

1. Gst can be avail on that Invoice ?

09 July 2024 Yes, Goods and Services Tax (GST) can generally be availed on the invoice raised by the tour organizer for the tour package services provided within India. Here are the key considerations:

### 1. Nature of Services:
- **Tour Package Services:** When you engage a tour organizer who provides comprehensive services such as transportation, hotel bookings, and food arrangements, these services are typically considered as bundled services under GST.

### 2. Eligibility for Input Tax Credit (ITC):
- **ITC Availability:** According to GST rules, you can claim Input Tax Credit (ITC) on goods or services used or intended to be used in the course or furtherance of business. Since the tour services are procured for business purposes (staff tour), ITC can be availed on the GST charged by the tour organizer.

### 3. Conditions for Availing ITC:
- **Compliance:** Ensure that the invoice from the tour organizer complies with GST invoicing requirements, including details such as GSTIN, invoice number, date, description of services, and GST amount charged.

- **Payment and Reporting:** The ITC can be claimed based on the invoice received from the tour organizer. Ensure that the payment for the invoice is made within 180 days from the invoice date to claim ITC as per GST rules.

### 4. Documentation and Compliance:
- **Maintain Records:** Keep all invoices, payment receipts, and related documents properly filed. These documents serve as evidence for claiming ITC during GST audits.

### Conclusion:
In summary, you can avail GST Input Tax Credit on the invoice raised by the tour organizer for providing tour package services within India, provided the invoice complies with GST regulations and the services are used for business purposes. It's advisable to consult with a tax professional or chartered accountant to ensure compliance with GST laws and maximize eligible ITC claims effectively.
