IT returns


22 March 2010 how can a person getting salary in cash can file his/her return since in this case he doesn't receive form 16 from the company.

how is it possible to file the return? please suggest.

22 March 2010 There is no bar in issuing TDS certificate, if salary is paid in cash.

22 March 2010 salary more then 150k because of that your company not issue Form no. 16.

in your case company is liable to deduct TDS but company not deduct tds and pay full salary in cash.
if company give form 16 then liability of TDS arise and company comes under default of sec 192, all salary and bonus will be disallowed to company.

so file return disclosing income blow taxable limit is batter option

22 March 2010 Welll, it was liability of the company to deduct TDS. and its not done. So now just pay advance tax before 31st march for the tax amount or pay Self asseesment tax later. TDS certificate is not required for it. So dont worrry.
File the return as it has to be done regularly.....

22 March 2010 Yes you can show income less than 150k, but ask company to give form16 for less amount to be on safer side if its a small pvt company.
First thing its not your fault so dont worry. If you want to show actual amount, than u can do as per my earlier advice. in that u can have more amount in White. so you can do both ways...
