It return without form 16

23 July 2012 I was regularly filing my returns perfectly all these years. But during last year (2011-12) my employer (due to financial problems) had paid the salaries until Aug '11 only and after that, none of the employees were paid with their salaries. Even, we were not issued with Form 16, at the end of the year. There was rumor that the deducted tax was also not paid with the Income Tax Department, by the employer.

In these circumstances, I resigned and joined another company in the month of February 12. At such a situation, how it is required to file a return for me. What is the implied rule in such a situation. If I don't file for this year, will I face any problem in the future.

Can anybody guide me with your suggestions?

You can check online whether your TDS deducted by Company is paid or not from the below link:
https://incometaxindiaefiling.gov.in/portal/form26ASInfo.do

Further you can file your return on or before 31-7-12 for the AY 2012-13,(Form ITR 2) without Form 16.
