01 August 2024 The applicability of Service Tax on domain name registration and web hosting services has been a subject of discussion in the past. Here is a detailed explanation based on the historical context and the transition to the Goods and Services Tax (GST) regime in India:

### Under Service Tax Regime (Pre-GST)

#### Domain Name Registration
1. **Nature of Service**: Domain name registration is considered a service. The service provider (your client) facilitates the registration of a domain name, which involves reserving a name on the Internet for a certain period.
2. **Taxability**: Under the Service Tax regime, domain name registration was considered a taxable service. This was because the service fell under the category of "online information and database access or retrieval services" or "telecommunication services".
3. **Applicable Notification**: According to Notification No. 25/2012-Service Tax, there was no specific exemption for domain name registration services. Therefore, it was subject to Service Tax.
4. **Rate**: The applicable rate of Service Tax was 15% (including cess) before the introduction of GST.

#### Web Hosting Services
1. **Nature of Service**: Web hosting services, which involve hosting websites on servers, were clearly taxable under the category of "information technology software services" or "support services for business or commerce".
2. **Taxability**: These services were always subject to Service Tax under the pre-GST regime.
3. **Rate**: The same 15% Service Tax rate applied.

### Under GST Regime (Post-July 2017)

#### Domain Name Registration
1. **Nature of Service**: Under GST, domain name registration continues to be considered a supply of service.
2. **Taxability**: Domain name registration services are subject to GST. These services fall under the SAC (Services Accounting Code) 998431, which pertains to "Online information and database access or retrieval services".
3. **Rate**: The applicable GST rate for these services is 18%.

#### Web Hosting Services
1. **Nature of Service**: Web hosting services are also treated as supply of services under GST.
2. **Taxability**: These services fall under the SAC 998313, which pertains to "Hosting and IT infrastructure provisioning services".
3. **Rate**: The applicable GST rate is 18%.

### Conclusion

1. **Service Tax Era**: Under the Service Tax regime, both domain name registration and web hosting services were taxable, and service providers were required to charge Service Tax.
2. **GST Era**: Post-July 2017, under the GST regime, these services are subject to GST at the rate of 18%.

### Compliance

Your client should ensure compliance with GST regulations, which includes:
- **Charging GST**: Charging GST at the rate of 18% on both domain name registration and web hosting services.
- **Invoicing**: Issuing GST-compliant invoices to their customers.
- **GST Returns**: Filing regular GST returns and remitting the collected tax to the government.

### Legal References

- **Service Tax**: There is no specific judgment available that exempts domain name registration from Service Tax, as it was always considered a taxable service.
- **GST**: The GST rate and applicability are defined by the GST Council and can be verified in the GST Rate Notifications and SAC codes provided by the Central Board of Indirect Taxes and Customs (CBIC).

If your client has not been charging tax on these services, it is advisable to consult a tax professional or GST consultant to ensure compliance and address any past liabilities.
