It is true filing has been by putting wrong figure in General Part 2 in ITR 5 where each partner's remuneration is shown. I have filed a revised return but after the expiry date of notice period. I have some tax refund. So, what to do next?

If you have missed the 30-day deadline to respond to the intimation under Section 143(1) and have already filed a revised return, here’s what you should do:
### **1. Understand the Situation**
- **Variance Noted**: The intimation indicates a variance of Rs. 50,000 in the partners' remuneration between the "General Part 2" and the "Profit & Loss Account." - **Revised Return**: You have filed a revised return after the expiry of the notice period. - **Tax Refund**: You are due a tax refund.
### **2. Steps to Take**
#### **A. **Verify the Revised Return**
- **Ensure Accuracy**: Confirm that the revised return accurately reflects the corrected figures for partners' remuneration and all other discrepancies noted in the intimation.
#### **B. **Check the Status of Revised Return**
- **Verify Submission**: Ensure the revised return has been accepted and processed by the Income Tax Department. You can check this on the [Income Tax e-Filing Portal](https://www.incometax.gov.in/iec/foportal/) under `e-File` > `Income Tax Return` > `View Filed Returns`.
#### **C. **Handling the Missed Response**
1. **No Option for Online Response**: If you cannot see an option to respond online due to the expired notice period, you will need to address this manually.
2. **Submit a Written Response**: Prepare a detailed letter explaining the error and the corrective actions taken. Attach relevant documents such as: - **Revised Return Confirmation**: A copy of the revised return. - **Proof of Filing**: Acknowledgment receipt of the revised return. - **Supporting Documents**: Any other relevant documents justifying the correction.
3. **Contact the Assessing Officer**: - **Visit the Local Income Tax Office**: Submit the written response and supporting documents to the Income Tax Office. - **Seek Clarification**: Request confirmation on how the rectification will be processed despite the missed response deadline.
#### **D. **Address the Refund**
- **Refund Processing**: The processing of the refund may be impacted if there are unresolved issues or discrepancies. Ensure that the revised return is processed and the refund claim is accurate.
#### **E. **Follow-Up**
- **Monitor Status**: Regularly check the status of your rectification and refund on the e-filing portal. - **Contact the Helpdesk**: If necessary, contact the Income Tax Helpdesk or the Assessing Officer for updates.
### **3. Considerations**
- **Legal Implications**: Late responses may lead to additional scrutiny. Make sure you maintain clear records and follow up diligently. - **Consult a Tax Professional**: If you face difficulties, consulting a tax professional or Chartered Accountant (CA) may be beneficial to navigate the situation effectively.
### **Summary**
1. **Confirm** the accuracy of the revised return. 2. **Submit a Written Response** manually to the Income Tax Office explaining the issue. 3. **Follow Up** on the revised return status and refund processing.
By taking these steps, you should be able to address the issues arising from the intimation and ensure that your tax matters are in order.
